The internet has given everyone a voice, but unfortunately, many use it as a weapon. Every week, young professionals, students, and homemakers visit my chamber in Dwarka, deeply traumatized because someone is spreading vicious rumors, morphed pictures, or abusive comments about them on Instagram, Facebook, or WhatsApp groups.
Most victims simply block the abuser and suffer in silence. But as a lawyer, I am here to tell you: Online defamation is a serious crime, and the law gives you the power to fight back.
What Constitutes Online Defamation?
Under Indian Law, specifically Section 356 of the Bharatiya Nyaya Sanhita (BNS) (which replaced Section 499 IPC), defamation occurs when someone intentionally publishes a false statement about you that harms your reputation.
When this is done using a computer or smartphone (social media, emails, WhatsApp), the provisions of the Information Technology (IT) Act, 2000 (External Link) also come into play.
Examples of Cyber Defamation:
- A bitter ex-partner posting private/false things about you on social media.
- A relative forwarding false rumors about your character in family WhatsApp groups.
- Anonymous accounts leaving abusive, character-assassinating comments on your profile.
The 3-Step Legal Counter-Attack
If you are a victim, do not panic and do not delete the evidence. Follow these steps:
1. Preserve the Evidence
Courts and police need proof. Take screenshots of the posts, comments, and the abuser’s profile. Most importantly, copy the exact URL (web link) of the post.
2. The Legal Notice (Cease & Desist)
Often, a strongly worded Legal Notice from an Advocate is enough to scare a troll into deleting the post and issuing an apology. The notice clearly outlines the criminal and civil consequences if they do not comply within 24-48 hours.

3. Cyber Cell FIR & Civil Suit
If the abuser is stubborn or anonymous, we take the battle to the authorities:
- Criminal Action: We file a formal complaint via the National Cyber Crime Reporting Portal (External Link) and local cyber police station to trace the IP address and arrest the culprit.
- Civil Action: We file a civil suit for Defamation in the District Court or High Court, demanding heavy monetary compensation (damages) for the mental agony and loss of reputation caused to you.
