Introduction : Live-In Relationship
In India, the concept of marriage is evolving. Many young couples prefer to know each other through a “Live-in Relationship” before tying the knot. But the biggest question I face in my Dwarka office is: “Sir, is this legal? Can the police arrest us?”
The Legal Stance
Let me be clear: Living together is NOT a crime. The Supreme Court of India, in multiple judgments, has upheld that two consenting adults have the right to live together.
The Necessity of a Live-in Agreement
However, “Legal” does not mean immune to problems. I strongly recommend a Live-in Relationship Agreement.
- For Men: It acts as proof that the relationship was consensual, protecting you from false allegations of rape on the pretext of marriage.
- For Women: It establishes the nature of the relationship, securing rights under the Domestic Violence Act, 2005 for maintenance and residence.
