Can an NRI Give Power of Attorney to Someone in India?

Yes, an NRI can in appropriate circumstances authorize a person in India to act on their behalf. However, the authority should be limited to the acts that the NRI actually intends to authorize.

For property transactions, the POA should be reviewed together with the underlying title documents, transaction documents and applicable registration requirements.

Important:

A Power of Attorney does not automatically transfer ownership of property to the attorney holder. The attorney's authority comes from the powers actually granted by the principal and remains subject to applicable law and the transaction documents.

What Should an NRI Property Power of Attorney Contain?

The contents depend on the transaction, but a property-related POA may need to clearly identify:

  • The full details of the attorney.

  • Authority concerning specified documents and applications.

Can an NRI Execute a Power of Attorney Abroad?

An NRI living outside India may execute a Power of Attorney abroad, but the applicable authentication process depends on the country, the manner of execution and the intended use of the document in India.

Section 33 of the Registration Act, 1908 sets out categories of powers of attorney that may be recognized for purposes of presenting documents for registration. Where the principal resides outside India, the provision refers to execution and authentication before specified authorities, including a Notary Public or an Indian Consul/Vice-Consul in the circumstances covered by the provision.

The Ministry of External Affairs also explains the use of apostillation for certain documents executed abroad and intended for use in India. The exact process should be checked for the country where the document is executed.

Power of Attorney for NRI Property Sale

When an NRI wants to sell property in India without personally attending every stage, a carefully drafted POA may be considered for the acts that need to be performed by a representative.

Before execution, the NRI should verify the title, ownership, transaction documents, consideration, applicable tax issues, foreign-exchange requirements and the registration procedure.
