Bank Account Frozen? Here is How to Unlock it (Legal Procedure)

By Advocate Ajay Malik | Supreme Court, Delhi High Court & District Courts

Imagine going to pay for groceries and finding your transaction declined. You check your app and see “Account Frozen” or “Lien Marked.”

In recent months, thousands of innocent people—especially crypto traders (P2P), freelancers, and online gamers—have faced this issue. The Cyber Police block the entire account even if only ₹5,000 is disputed.

The Good News: You can get it unfrozen.

Under the new Bharatiya Nagarik Suraksha Sanhita (BNSS), specifically Section 503 and 505 (formerly Section 457 CrPC), the Magistrate Court has the power to release your account.

Why Was My Account Frozen?

It is usually due to a “Layering” complaint.

  1. A victim reports a fraud on the 1930 Helpline.
  2. The police trace the money trail.
  3. If the fraudster sent money to Person A, who sent it to Person B (You), your account gets frozen automatically.

You are likely not the suspect, but a “suspected beneficiary.”

Step-by-Step Unfreezing Process

Step 1: Get Details from Your Bank

Visit your home branch immediately. Do not accept a verbal answer. Demand the Cyber Cell Notice which contains:

  • Acknowledgement No: (e.g., 2080123…)
  • Police Station: (e.g., Cyber Cell Bangalore, Gujarat CID)
  • Investigating Officer (IO) Name & Number.

Step 2: Representation to the IO (The NOC Route)

I draft a legal representation to the Cyber Cell explaining your innocence. We attach:

  • KYC Documents.
  • Bank Statement.
  • Proof of Transaction (e.g., Invoice, Binance Chat, Screenshot).

If the IO is satisfied, they issue a No Objection Certificate (NOC) to the bank, and the freeze is lifted.

Step 3: Approach the Court (Section 503/505 BNSS)

If the police do not respond (which happens often), we file a petition in the Magistrate Court.

We argue that keeping the account frozen violates your fundamental rights. The Court then orders the bank to:

  1. Keep the Disputed Amount (e.g., ₹10,000) on hold.
  2. UNFREEZE the rest of the account for your use.

Don’t Wait!

A frozen account can ruin your CIBIL score and business reputation.
