Weekends in Delhi NCR are vibrant, but a night out can quickly turn into a nightmare if you encounter aggressive private security. A disturbing trend in upscale clubs and bars is the use of brute physical force by bouncers to “manage” patrons.
Many victims simply go home, feeling humiliated and helpless, assuming that because it happened on “private property,” the club is untouchable. As a criminal defense lawyer, I am here to tell you: Bouncers are not above the law. They have zero police powers.
The Myth of Bouncer Authority
Let us be absolutely clear about what a bouncer can and cannot do under Indian Law. A bouncer is merely a private citizen hired by a commercial establishment.
- What they CAN do: They can politely deny you entry based on club policy, ask you to leave the premises, and call the actual police if you refuse.
- What they CANNOT do: They cannot push you, slap you, drag you, confiscate your phone, or lock you in a back room.
If a bouncer initiates physical contact, they are committing a crime under the Bharatiya Nyaya Sanhita (BNS) for Voluntarily Causing Hurt, Criminal Intimidation, and Wrongful Confinement.
Your 3-Step Action Plan for Justice
If you are assaulted by private security, do not retaliate physically—that weakens your case. Follow these exact steps:
1. Call 112 and Do Not Leave Quietly
Immediately dial 112 (Police) from the spot. Create a record that an incident occurred. Demand that the police secure the CCTV footage of the club immediately, as management often deletes this evidence within 24 hours.
2. Get an MLC (Medico-Legal Case) Report
Do not go home to ice your bruises. Go directly to the emergency ward of the nearest Government Hospital and tell them you were assaulted. They will prepare an MLC report detailing every scratch, bruise, and injury. This medical report is the most powerful evidence you have to force the police to register an FIR.
3. Sue the Management (Vicarious Liability)
At Delhi Law Advocates, we don’t just go after the bouncer. The bouncer is an employee; the deep pockets belong to the club owner. Under the legal principle of Vicarious Liability, the club management is legally and financially responsible for the actions of their staff. We file civil suits demanding heavy compensation for your medical bills, mental agony, and public humiliation.
You have the right to a safe environment. Do not let establishment owners get away with hiring thugs.
