Living in the Dark? What to Do When Your Landlord Illegally Cuts Your Electricity

It is the middle of the summer in Delhi. You have a minor argument with your landlord over a delayed rent payment or a repair issue. The next evening, you come home from work, and your flat is pitch black. The water taps are dry. Your landlord has cut off your electricity and water to “teach you a lesson” or force you to vacate.

This is a terrifying and humiliating experience. Most tenants, desperate and sweating in the dark, either pay whatever extortion amount the landlord demands or pack their bags the next day.

As a property lawyer, I want every tenant to memorize this one fact: Cutting off essential services is completely illegal, and you can legally force them to turn it back on.



The Law Protects Essential Services

It does not matter whose name is on the property registry. It does not matter if your rent agreement has expired. It does not even matter if you haven’t paid rent for three months!

The law recognizes water and electricity as fundamental human rights necessary for survival. Under Section 45 of the Delhi Rent Control Act (and corresponding civil laws for properties outside this act), no landlord can cut off or withhold essential supply without a formal order from a court.

A landlord who does this is taking the law into their own hands, which courts in India severely punish.

Your Step-by-Step Action Plan

If your power is cut, do not go to your landlord’s door and start a physical fight. Follow these legal steps to crush their bullying tactics:

1. Call 112 Immediately

Dial the police helpline. Tell them, “My landlord is illegally harassing me and has cut off my basic life supplies to force an illegal eviction.” The police usually cannot force the landlord to restore it permanently (as it’s a civil dispute), but generating a Police PCR Call Record is vital evidence of their illegal act.

2. Do Not Stop Paying Rent

If you have the rent money, send it via bank transfer or cheque. If they refuse to accept it, deposit it via money order. You must prove to the court that you are a bona fide tenant.

3. Get an Emergency Court Injunction

This is where we step in. We draft an urgent petition and file it before the Civil Judge or the Rent Controller. We ask for an ex-parte (immediate) Mandatory Injunction.

Judges take a very harsh view of landlords acting like thugs. The court will issue a direct, binding order commanding the landlord to restore the electricity and water within 24 to 48 hours. If the landlord disobeys this order, they will be charged with Contempt of Court and can be sent to jail.

You have the right to live with dignity. Do not let rogue landlords bully you out of your home.
