Why Skipping Tenant Police Verification Can Land You in Jail (BNS Sec 223)

Owning rental property in Delhi NCR is a fantastic source of passive income, but it comes with strict legal responsibilities. One of the most dangerous mistakes property owners make is handing over the keys to a new tenant based purely on a property broker’s verbal guarantee, skipping the formal police verification process.

“The broker knows them,” or “They look like a decent family,” are excuses that hold absolutely zero weight in a court of law. If you do not have a formal police verification receipt, you are sitting on a legal time bomb.



The Law: Section 223 of the BNS

In Delhi, the Commissioner of Police routinely issues orders making it legally mandatory for every landlord to submit their tenant’s details to the local police station.

Under Section 223 of the Bharatiya Nyaya Sanhita (BNS) (which replaced the old IPC Section 188), if you disobey a legal order issued by a public servant, it is a criminal offense. You can face imprisonment, heavy fines, or both.

The Real Danger: Vicarious Criminal Liability

The penalty for simply failing to submit the form is one thing. The real danger happens if your unverified tenant commits a crime.

Suppose your tenant uses your flat to run a cyber-fraud call center, store illegal liquor, or hide stolen goods. When the police raid the property, the tenant might abscond. Who does the police catch? The Landlord.

Because you failed to do the mandatory verification, the investigating officer will legally presume that you were either careless, or worse, that you were an accomplice who knew about the illegal activities and took a cut of the profits. You will be named in the FIR, and you will have to fight for Anticipatory Bail to avoid going to jail.

How to Protect Yourself (It Takes 5 Minutes)

The days of standing in long lines at the police station are over.

  1. Do it Online: Use the Delhi Police official website or download the “Tatpar” mobile app.
  2. Upload Documents: You just need the tenant’s Aadhar Card, a photograph, and their permanent address details.
  3. Keep the Receipt: The system will generate a digitally signed receipt. This receipt is your shield. Print it and attach it to your Rent Agreement.
